Please read these Terms and Conditions (“Terms”, “Agreement”) carefully before using the kainatbabar.com website (the “Service”) operated by KB (“us”, “we”, or “our”), located at MM Alam Rd, Block T Gulberg 2, Lahore, Pakistan.

1. ACCEPTANCE OF TERMS

By accessing this website, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and our Return/Shipping Policies. If you disagree with any part of these terms, you must immediately discontinue use of the Service.

2. ELIGIBILITY AND ACCOUNT SECURITY

Age: You must be at least 18 years of age to make a purchase.
Account Accuracy: You are responsible for ensuring that all information provided (name, address, and phone: 03170089700) is accurate. Providing false data is a violation of the Prevention of Electronic Crimes Act (PECA) 2016.
Account Confidentiality: You are responsible for maintaining the confidentiality of your account credentials. KB is not liable for unauthorized access resulting from user negligence.

3. INTELLECTUAL PROPERTY RIGHTS

Ownership: All content on kainatbabar.com, including but not limited to textile designs, silhouettes, brand names, logos, digital photography, and website code, is the exclusive intellectual property of KB.
Restrictions: You may not reproduce, copy, sell, or exploit any portion of our designs for commercial use. “Design Infringement”—the act of replicating our pret patterns for local production—is strictly prohibited and will be prosecuted under the Copyright Ordinance 1962 and Intellectual Property Organization (IPO) of Pakistan laws.

4. PRODUCT REPRESENTATION & PRICING

Accuracy: We strive to display the colors and textures of our pret wear as accurately as possible. However, due to variations in digital displays and studio lighting, we do not guarantee that the color you see on your screen is a 100% match to the physical fabric.
Pricing: All prices are listed in Pakistani Rupees (PKR).
Taxation: In compliance with the 2025-2026 Finance Act, an 18% Sales Tax is applicable. Prices are [Inclusive/Exclusive] of this tax. KB reserves the right to adjust prices without prior notice due to fluctuations in raw material costs or government-imposed duties.

5. ORDERING AND CONTRACT FORMATION

Order Acceptance: Your receipt of an order confirmation does not signify our acceptance. We reserve the right to refuse service to anyone for any reason, including suspected fraudulent activity or stock unavailability.
Verification: All orders, specifically Cash on Delivery (COD), require a mandatory telephonic or WhatsApp verification to our official line: 03170089700. Unverified orders will be auto-cancelled after 48 hours.
Order Limits: We reserve the right to limit the quantity of items purchased per person or per household.

6. PAYMENT TERMS

Accepted Methods: We accept Cash on Delivery (within Pakistan), Bank Transfers, and Credit/Debit Cards (Visa, MasterCard) via secure 2026-compliant payment gateways.
Payment Failure: If your payment is declined by the issuer, KB is not responsible for any delay or non-delivery of your order.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by the laws of Pakistan:

KB shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or the inability to use our products.
We are not responsible for any allergic reactions or skin sensitivities caused by specific fabric dyes or embellishments. Customers are advised to check fabric compositions listed on the website.

8. FORCE MAJEURE

KB shall not be held liable for any delay or failure in performance of any part of this agreement to the extent that such delay or failure is caused by events beyond our reasonable control, including but not limited to:

Natural disasters or “Acts of God.”
Political instability, strikes, or civil unrest in Lahore or other delivery zones.
Nationwide internet outages or logistics infrastructure failures.

9. TERMINATION OF USE

We reserve the right, without notice and at our sole discretion, to terminate your account or your use of the website and to block future access if we determine you have violated these Terms or engaged in behavior detrimental to the brand.

10. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the Courts of Lahore.

11. MODIFICATIONS TO TERMS

KB reserves the right to update or modify these Terms at any time without prior notice. Your continued use of kainatbabar.com after any changes constitutes your acceptance of the new Terms.
